Coincidently, I actually received this email last week about a class action lawsuit against LA Fitness:



EMAIL SUMMARY NOTICE

TO ALL CURRENT MEMBERS OF LA FITNESS WHO PROVIDED
THIS EMAIL FOR THEIR ACCOUNT

RECORDS INDICATE THAT YOU ARE A CURRENT MONTHLY DUES MEMBER OF L.A. FITNESS AS OF
SEPTERMBER 30, 2009. THIS NOTICE IS TO INFORM YOU OF A PROPOSED CLASS ACTION SETTLEMENT
THAT COULD AFFECT YOUR LEGAL RIGHTS. THIS IS NOT A SOLICITATION. YOU ARE NOT BEING SUED.

A lawsuit is pending in the Superior Court of the County of Los Angeles that may affect your rights. This lawsuit, Williams et al. v. L.A. Fitness, No. BC385623, alleged that L.A. Fitness used improper contract forms and unfairly charged dues after notice of cancellation. L.A. Fitness has denied any wrongdoing. The parties have reached a proposed settlement of the lawsuit. The settlement and this notice have been preliminarily approved by the Court.

The Class is identified as, “all Individuals who entered into Monthly Dues Membership Agreements with L.A. Fitness In The State Of California and (1) are Former Monthly Dues Members who gave Notice Of Cancellation of their Monthly Dues Membership Agreements on or after February 15, 2004, or (2) are Current Monthly Dues Members.”

Subject to final court approval, the parties have agreed to a settlement under which Current Monthly Dues Members like you will be entitled to injunctive relief prohibiting L.A. Fitness from collecting dues for any month after the month the member sends in a notice of cancellation (this injunctive relief will not prohibit L.A. Fitness from applying prepaid last month dues during this period). L.A. Fitness will begin using a new contract form consistent with this settlement. Current Monthly Dues Members may obtain a copy of the new L.A. Fitness contract form by visiting www.gymsettlement.com. The above changes to the contract will apply even if the Current Monthly Dues Member does not obtain a copy of the new contract form. Former Monthly Dues Members will be able to choose between a cash payment or 45 Day Club Access Pass.

A final approval hearing is scheduled for April 30, 2010 in Dept. 52 of the Los Angeles County Superior Court. You may accept the settlement, object to the settlement, or “opt out” of the settlement. You may also appear at the hearing to state your views on the settlement. If you wish to object or opt-out, your request must be postmarked by March 19, 2010.

All class members who do not exclude themselves by March 19, 2010 will release any claim they may have against L.A. Fitness relating to the allegations in this lawsuit.

Mike Shanahan was hired by the Redskins. However, I think they also need to hire a new owner. Thoughts @Adam_Schefter ?

Following the firing of Jim Zorn on January 4, 2010, unconfirmed reports circulated that the Washington Redskins had hired former Denver Broncos head coach Mike Shanahan. According to The Denver Post and Adam Schefter of ESPN, Shanahan agreed to a five-year contract paying about $7 million a year on January 5, 2010.http://twitter.com/mortreport/status/74237512012 The official announcement could come as soon as January 6, 2010.http://www.denverpost.com/sports/ci_141279833


Since Zorn took over the franchise in 2008, he las led the Redskins to just 12 wins and 20 losses between the two seasons. Their 4-12 record landed the team last in the NFC East, their worst season since 1994.
